Agreement to Terms
By accessing or using the Kids Go Out mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
1. Eligibility
1.1 Age Requirement
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use Kids Go Out. By using the App, you represent and warrant that you meet this age requirement.
1.2 Parental Consent
If you are under 18, you may only use Kids Go Out with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
1.3 Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring your account information is accurate and up-to-date
2. Description of Service
2.1 What Kids Go Out Provides
Kids Go Out is an AI-powered mobile application that helps parents and caregivers discover family-friendly activities. Our services include:
- AI Chat Assistant: Conversational interface for finding activities
- Activity Search: Browse and search for local activities
- Daily Discoveries: Personalized activity recommendations
- Activity Management: Save and track activities you've visited
- Map Integration: View activities on an interactive map
2.2 Service Modifications
We reserve the right to:
- Modify, suspend, or discontinue any feature at any time
- Change pricing for premium subscriptions (with notice)
- Update the App with new features or improvements
3. Premium Subscriptions
3.1 Subscription Plans
Kids Go Out offers premium subscriptions with the following terms:
- Monthly Subscription: $4.99/month
- Annual Subscription: $39.99/year
- Free Trial: 7-day free trial (if applicable)
3.2 Billing and Renewal
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Your iTunes account will be charged upon confirmation of purchase
- Renewal charges occur within 24 hours prior to the end of the current period
- No refunds for partial subscription periods
3.3 Cancellation
- Cancel anytime through iOS Settings → Apple ID → Subscriptions
- Access continues until the end of the current billing period
- No refunds for unused time after cancellation
3.4 Free Trial
- 7-day free trial for new subscribers
- Charged after trial ends unless canceled
- One free trial per Apple ID
4. User Conduct
You agree NOT to:
- Use the App for any illegal purpose
- Violate any laws in your jurisdiction
- Harass, abuse, or harm others
- Impersonate any person or entity
- Upload malicious code or viruses
- Attempt to gain unauthorized access to our systems
- Scrape, spider, or crawl the App
- Reverse engineer or decompile the App
- Use the App to send spam or unsolicited messages
- Share your account with others
5. Intellectual Property
5.1 Our Content
Kids Go Out and its original content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws.
5.2 Third-Party Content
Activity information, photos, and reviews may be sourced from:
- Google Places API (property of Google LLC)
- User-submitted content
- Public databases and directories
5.3 User-Generated Content
By submitting content (reviews, photos, feedback), you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Service.
6. AI-Generated Content
- AI recommendations are generated using OpenAI's GPT technology
- Recommendations are suggestions only, not professional advice
- We do not guarantee accuracy, completeness, or suitability
- Always verify information before visiting activities
- Use your judgment when selecting activities for your children
7. Disclaimers
7.1 Service "As Is"
Kids Go Out is provided "as is" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of content
7.2 Third-Party Activities
We are not responsible for:
- Safety or suitability of activities
- Accuracy of venue information
- Quality of experiences
- Pricing changes or closures
- Injuries or incidents at activities
8. Limitation of Liability
To the maximum extent permitted by law, Kids Go Out and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
9. Indemnification
You agree to indemnify and hold harmless Kids Go Out from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
10. Privacy
Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices.
11. Termination
We may terminate or suspend your account and access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination:
- Your right to use the App ceases immediately
- Your account will be deactivated
- Your data will be retained per our Privacy Policy
12. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in California.
13. Dispute Resolution
13.1 Informal Resolution
Before filing a claim, you agree to contact us at contact@kidsgoout.com to attempt to resolve the dispute informally.
13.2 Arbitration
Any dispute not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
13.3 Class Action Waiver
You agree to resolve disputes on an individual basis only, not as part of a class action or collective proceeding.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the App. Your continued use of the App after changes constitutes acceptance of the modified Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
